In Maryland, there is no requirement for parents to contribute to college costs for adult children. Child support obligations terminate upon a Child reaching the age of majority. If parents use a dispute resolution process outside of Court, they may choose to include a provision regarding college expenses, and the sharing thereof, in their marital settlement agreement. This would be a voluntary decision of the part of the parents to provide this financial support; however, once committed to doing so in a marital settlement agreement, this creates a contractual commitment which may be enforced by the Court. If divorcing by contested litigation, the Court will not address the issue of college expenses and any Judgment of Divorce will be silent regarding these costs. It will be up to the parents to sort out with their children when the child is ready to enroll in college.
