If the spouses are able to resolve the issues of child custody, child support, alimony, property distribution, and any other disputes they may have by some out of court settlement process (Mediation, Collaborative Process, or attorney-negotiated settlement) which results in signing a Marital Settlement Agreement, the parties may proceed with an uncontested divorce. An uncontested divorce can take approximately three to four months total, depending upon the volume of divorce cases pending in the Court in your jurisdiction.
If the spouses are not able to resolve the divorce topics listed above outside of court, then a contested divorce case will be initiated by filing a complaint for divorce. The contested divorce cases typically take approximately one year to be resolved; however, various factors may sometimes lead to the cases taking longer than a year to reach full resolution.
